Informational Item – Status of Bluegrass Water Supply Commission

The last monthly BWSC meeting was held in Lancaster on April 16, 2007.  The minutes (draft) of that meeting have been provided (C-5/1-15). 

Upon request of legal counsel, the BWSC voted to file a motion requesting full intervention in PSC Case No. 2007-00134 (KAW’s Certificate of Convenience and Necessity to construct the proposed regional water treatment plant on pool 3 and transmission line).

There were two primary reasons the BWSC wanted to intervene in the case.  First, so the BWSC could show support for the equity-ownership approach in the regional project.  Second, to obtain information; should the BWSC be allowed full intervention, the BWSC would be privileged to copies of all documents, orders, date requests and other correspondence from the PSC and its staff. 

As of May 3, 2007, the PSC has granted the following entities to intervene in the case:

  1. Attorney General’s Office
  2. Lexington-Fayette Urban County Government
  3. BWSC
  4. Kentucky Industrial Utility Customers, Inc. ( Toyota , Lexmark, Square D, others).

The Citizens for Alternative Water Solutions (CAWS) filed a Motion for Full Intervention on May 3, 2007.  CAWS is the newly created non-profit organization composed of Franklin County property owners who will be affected by the proposed 42" pipeline.  The PSC should rule on this Motion within the next week to 10 days.
